Yezdi Trademark Dispute: Boman Irani and Classic Legends Win Rights

The Karnataka High Court has ruled in favor of Boman Irani, granting Classic Legends full rights to the Yezdi trademark. The court held that Ideal Jawa abandoned the brand through non-use.

Karnataka High Court Grants Yezdi Trademark Rights to Boman Irani and Classic Legends

The Karnataka High Court’s Division Bench has delivered a significant verdict regarding the ownership of the iconic Yezdi motorcycle brand. The court ruled that the rights to the Yezdi trademark belong to Boman Irani and Classic Legends, setting aside the claims of the long-defunct Ideal Jawa and its Official Liquidator.

This ruling overturns a 2022 Single Judge order that had previously treated the Yezdi brand as an asset of the old company, effectively clearing the legal path for Classic Legends to secure the brand’s future in India.


The Case of Abandonment by Ideal Jawa

The core of the High Court’s decision rests on the legal principle of abandonment. The court observed that a brand cannot be locked away in memory and claimed decades later without active use.

Ideal Jawa ceased motorcycle production in 1996 and entered liquidation in 2001. Following this, the Yezdi trademark registrations lapsed between 2007 and 2008 and were subsequently removed from the Trade Marks Register. The court noted that for over 15 years, neither the company nor the Official Liquidator attempted to renew the registrations or protect the brand from third parties.

Furthermore, the trademark was not listed as an asset during previous valuations or sale notices. The Bench ruled that once a business stops and registrations lapse without any attempt to protect them, the goodwill attached to the mark ceases to exist. Consequently, the liquidator’s argument linking unpaid dues to the current brand value was deemed legally weak.

Boman Irani’s Active Stewardship

In contrast to Ideal Jawa’s inaction, the court highlighted the active steps taken by Boman Irani to keep the brand alive. Irani, whose family has deep roots with the Yezdi name, maintained the brand’s visibility through the yezdi.com domain after the original company shut down.

Irani began applying for new Yezdi registrations in 2013 and successfully obtained them lawfully. He actively defended the trademark against third parties, including legal battles in the Delhi High Court. Later, in 2015, he partnered with Anupam Thareja and Mahindra to form Classic Legends with the specific intent of reviving Yezdi.

The Division Bench viewed these actions as active stewardship rather than abandonment, validating his registrations under the Trade Marks Act.

Impact on the Indian Motorcycle Industry

This verdict provides Classic Legends with a clear legal title over the Yezdi brand, removing uncertainties surrounding their current and future product lineups. This legal clarity is vital for dealers, suppliers, and finance partners, offering a firm base for long-term investments and contracts.

The ruling also establishes a precedent for the wider industry, particularly for companies looking to revive dormant legacy brands. The court has sent a message that ownership cannot rely solely on nostalgia or old balance sheets. To utilize a heritage badge, a company must either keep the mark alive through actual use or acquire it through proper new registrations when it becomes available in the public domain.

Anupam Thareja stated that Classic Legends will now proceed with plans to make Yezdi meaningful for a new generation of riders.
